1. Introduction
These Terms of Service ("Terms") govern your access to and use of Drast, the AI SDR service operated by CALK SAS at drast.ai.

By creating an account, embedding the Drast script on a website, or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service. If you are entering into these Terms on behalf of a company, you represent that you have the authority to bind that company.
In these Terms, "Drast", "we", "us" and "our" refer to CALK SAS. "You" and "Customer" refer to the person or company using the service.
2. The service
Drast is a software-as-a-service product that provides an AI agent embeddable on B2B websites. The agent qualifies website visitors, handles common objections, books meetings into a connected calendar, and pushes captured leads to a connected CRM.
Drast may evolve over time. We may add, modify, or remove features. We will give reasonable notice of material changes that meaningfully reduce functionality customers rely on.
3. Your account
To use Drast, you must create an account. You may sign in by email and password, or with Google.
You are responsible for keeping your credentials confidential and for all activity under your account.
You must provide accurate information and keep it up to date.
You must be at least 18 years old, or the age of majority in your jurisdiction.
You may not share access with people outside your organization, or create accounts by automated means.
Notify us promptly at quentin@drast.ai if you believe your account has been compromised.
4. Beta features
Some features are offered as "beta" or "preview". Beta features are provided as-is, may be unstable, and may change or be removed without notice. Service-level commitments do not apply to beta features.
5. Acceptable use
You agree not to use Drast to:
Violate any applicable law or regulation, including data protection law.
Infringe on intellectual property, privacy, or other rights of third parties.
Send spam, malware, deceptive content, or content that harasses, threatens, or defames others.
Impersonate any person or entity, or misrepresent your affiliation.
Reverse engineer, decompile, or attempt to extract the source code of the service, except to the extent that applicable law expressly permits despite this limitation.
Probe, scan, test, or attempt to circumvent the security or integrity of the service.
Use the service to build a competing product, train a competing AI model, or scrape Drast outputs at scale.
Use the service in a context where failure could lead to physical harm, including life-support systems.
Deploy the agent on websites in regulated sectors where doing so would violate applicable rules (e.g., unauthorized financial advice, medical diagnosis, legal counsel).
You are responsible for the configuration of your Drast agent and for the content it serves to your visitors. You will not configure the agent to provide medical, legal, financial, or psychological advice unless you are licensed to do so and you take responsibility for the output.
6. Fair use & conversation quotas
Each plan includes a monthly conversation quota. A conversation is a unique back-and-forth session with a single visitor; sessions of fewer than 3 messages do not count.
If you exceed your quota, additional conversations are billed at the per-conversation overage rate listed for your plan.
We may apply reasonable rate limits to protect the service from abuse or runaway costs.
Sustained, abnormal usage that materially exceeds typical patterns for your plan may, at our discretion, require an upgrade or a custom contract.
7. Third-party services
Drast integrates with third-party services such as HubSpot, OpenAI, Qdrant, MongoDB and others. These services are operated by their own providers under their own terms.
You authorize Drast to access these services on your behalf via OAuth or similar mechanisms when you connect them.
We are not responsible for the availability, accuracy, or behavior of third-party services.
You are responsible for complying with the terms of any third-party service you connect.
You may revoke Drast's access at any time. Doing so may disable parts of the Drast service.
8. Customer data
You own your data. "Customer Data" means the data you upload, configure, or generate through your use of Drast โ including your knowledge base, the conversations between the agent and your visitors, and any data captured from those conversations.
You retain all rights, title, and interest in Customer Data.
You grant Drast a worldwide, non-exclusive, royalty-free license to host, process, and transmit Customer Data solely to operate the service for you.
We will not sell your Customer Data, and we will not use it to train AI models that benefit anyone other than you.
You are responsible for ensuring you have the necessary rights and consents to provide Customer Data to Drast and for the lawfulness of processing visitor data through the agent.
Where Drast processes personal data on your behalf, our Data Processing Agreement applies. Request a copy at quentin@drast.ai.
You may export your Customer Data at any time during the subscription. After termination, we retain Customer Data for up to 30 days to allow recovery, then delete it (subject to legal retention requirements such as billing records).
9. Intellectual property
Drast, including its software, agent behavior, design, brand, and documentation, is owned by CALK SAS and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription, subject to these Terms.
You may provide feedback or suggestions about the service. We may use that feedback freely, without restriction or compensation, to improve the service.
10. Fees, payment & taxes
Fees are listed at drast.ai and may vary by plan. They are billed in advance on a monthly or annual basis, in the currency shown.
Payment is processed by our payment provider. By providing payment information, you authorize us to charge the applicable fees.
Fees are exclusive of VAT and other taxes, which we will add where required by law.
Late payments may result in suspension. We may charge interest on overdue amounts at the maximum rate permitted by French law.
Pilot pricing or promotional discounts apply only to the period stated; standard pricing resumes thereafter.
11. Cancellation & refunds
You may cancel your subscription at any time from the Drast dashboard or by emailing quentin@drast.ai.
Cancellation takes effect at the end of the then-current billing period. You retain access until that date.
Fees already paid are non-refundable, except where required by applicable law.
If we materially decrease the service in a way that affects you, you may cancel and request a pro-rata refund for the unused portion of any prepaid period.
12. Suspension & termination
We may suspend or terminate your access to the service if:
You materially breach these Terms and fail to cure the breach within 14 days of written notice (or immediately, where the breach cannot reasonably be cured or where it presents a risk to the service or third parties).
You fail to pay fees when due.
We are required to do so by law or by a competent authority.
Continued provision of the service would expose Drast or its users to material legal, security, or operational risk.
You may terminate by canceling your subscription. On termination, your right to use the service ends. Provisions that by their nature should survive termination (including ownership, payment obligations, warranties, liability, and governing law) survive.
13. Warranties & disclaimers
We provide the service with reasonable skill and care. Beyond what is stated in these Terms or required by applicable law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, or that AI outputs will be accurate or fit for any specific use.
The Drast agent uses generative AI. Outputs may occasionally be incorrect, incomplete, or unexpected. You are responsible for reviewing the agent's behavior on your site and for ensuring that meeting bookings, lead data, and other outputs are validated before relied upon.
14. Limitation of liability
To the maximum extent permitted by law:
Neither party will be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity, even if advised of the possibility.
Our total aggregate liability for any claim arising out of or related to these Terms or the service will not exceed the amounts you paid to Drast in the 12 months preceding the claim.
Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Drast, its officers, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:
Your breach of these Terms.
Your violation of any law or third-party right (including intellectual property and privacy rights).
Customer Data or your configuration of the agent, including the content the agent serves to your visitors.
16. Changes to the service or terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. For material changes, we will give customers at least 30 days' notice by email or through the dashboard before the changes take effect. Continued use of the service after the effective date constitutes acceptance.
If you do not agree to a material change, your remedy is to cancel before the change takes effect and request a pro-rata refund for any unused prepaid period.
17. Governing law & disputes
These Terms are governed by the laws of France, without regard to conflict-of-laws rules.
Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Paris, France, except that consumers retain the right to bring proceedings in the courts of their country of residence where required by mandatory law.
Before filing a claim, the parties agree to attempt good-faith resolution by contacting quentin@drast.ai.
18. General
Entire agreement โ these Terms, together with the Privacy Policy and any Data Processing Agreement we sign with you, constitute the entire agreement between you and Drast regarding the service.
Severability โ if any provision is found unenforceable, the remaining provisions remain in full force.
No waiver โ failure to enforce a provision is not a waiver of our right to do so later.
Assignment โ you may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
Force majeure โ neither party is liable for delays or failures caused by events beyond reasonable control (natural disaster, war, internet outage, third-party provider failure, etc.).
Notices โ we may give notices by email to the address on your account or by posting in the dashboard.
Language โ these Terms are written in English. A French translation may be provided for convenience; in case of conflict, the English version prevails, except where French law mandates otherwise.
